These Terms and Conditions (“Agreement”) govern the use of services, facilities, and memberships provided by Olive Tree Recording Studios (“the Studio,” “we,” “us,” or “our”). By purchasing a membership, booking time, or using any Studio facility or equipment, you (“Member,” “Client,” or “Guest”) agree to be bound by this Agreement.

1. Membership Use & Booking Policy

Memberships provide access to Studio time based on the selected plan.

Sessions may be booked with a minimum of 2 hours advance notice, subject to availability.

Membership hours are valid only within the applicable billing cycle and do not roll over to the next billing period.

Unused membership hours are forfeited at the end of each billing cycle.

Additional credit packages purchased separately are valid for 30 days from the date of purchase and expire automatically if unused.

2. Cancellation & Refund Policy

Cancellations made more than 24 hours before a scheduled session will result in credits being returned to the Member’s account, provided they are within the same billing cycle.

Cancellations made within 24 hours of the scheduled session, or failure to attend, will result in:

Full deduction of credits

Non-refundable session fees

If a session is cancelled after it has begun, all credits and fees for that session will be forfeited in full.

3. Facility Rules & Conduct

To ensure a safe, professional, and productive environment:

Prohibited substances and items:

No smoking, vaping, or use of tobacco products anywhere on the premises.

No alcoholic beverages are allowed on-site.

No illegal substances or controlled drugs are permitted.

No weapons of any kind are allowed on Studio property.

Internet & Facility Use:

The Studio internet connection and facilities must not be used for illegal, abusive, or inappropriate activities.

Any misuse may result in immediate termination of access without refund.

Behavior:

Clients and guests must behave respectfully toward staff, equipment, and other users.

We reserve the right to remove any person engaging in disruptive, unsafe, or inappropriate behavior.

4. Studio Capacity & Guests

“Studio 1” has a maximum occupancy of 3 people total, including the primary client.

Exceeding the maximum capacity is strictly prohibited for safety, insurance, and operational reasons.

All guests are the responsibility of the booking Member.

All guest are required to be registered before their arrival. We’ll need their full name, email, and phone number.

5. Pets

Pets are not allowed on the premises.

Exception: certified service animals are permitted in compliance with applicable disability laws, provided they do not disrupt operations or pose safety risks.

6. Property, Equipment & Damages

Members are fully responsible for any damage caused to Studio property, equipment, or facilities by themselves or their guests.

Any damage will be assessed and billed at the full cost of repair or replacement, including labor and downtime if applicable.

The Studio reserves the right to charge the payment method on file or pursue recovery of costs through legal means if necessary.

7. Liability Waiver

Olive Tree Recording Studios is not responsible for:

Lost, stolen, or damaged personal property

Equipment brought in by clients or guests

Business losses, missed opportunities, or revenue loss

Service interruptions due to technical failure, maintenance, or force majeure events

Use of the Studio is at the Member’s own risk.

Members agree to indemnify and hold harmless Olive Tree Recording Studios, its owners, staff, and affiliates from any claims, damages, liabilities, or expenses arising from their use of the facility.

8. Force Majeure

The Studio is not liable for delays, cancellations, or inability to provide services due to events beyond reasonable control, including but not limited to natural disasters, power outages, government restrictions, internet failures, or emergencies.

9. Termination of Access

We reserve the right to suspend or terminate any membership or booking privileges at our discretion if a Member violates these Terms and Conditions, engages in unsafe behavior, or causes damage to Studio property.

10. Changes to Terms

Olive Tree Recording Studios reserves the right to update or modify these Terms and Conditions at any time. Continued use of the Studio after changes are posted constitutes acceptance of the revised terms.

11. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of the State of Texas, United States of America. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the competent courts in that jurisdiction.

12. Entire Agreement

These Terms and Conditions constitute the entire agreement between the Member and Olive Tree Recording Studios and supersede any prior agreements or understandings.

By using Olive Tree Recording Studios’ services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
